Commissioner Hablow, Cesar Vargas and Mario Arena from the Finance department came
before the committee to discuss Bond Act 2026-3 to authorize the County to issue Bonds in
the amount of $5,000,000 to finance real property tax refund payments becoming due and
payable during the 2026 fiscal year, pursuant to judicial proceedings brought under Article
Seven of the real Property Tax Law.
On motion of Legislator Holstein, seconded by Legislator Tubiolo, the above item was signed
by committee and referred to Board of Legislators. The motion carried by the following vote:

ACT-First Amendment-IMA-NYCDEP-Watershed
AN ACT authorizing the County of Westchester to enter into a first amendment to an
intermunicipal agreement with the New York City Department of Environmental Protection for
the delegation to the County of Westchester, the administration and enforcement of Section
18-38 of Subchapter G of New York City's "Rules and Regulations for the Protection from
Contamination, Degradation and Pollution of the New York City Water Supply and its
sources", whereby the County will review and issue written determinations for all new, altered,
modified or remediated subsurface sewage treatment systems located in the portion of the
watershed of the New York City water supply situated within Westchester County in order to
extend the termination date from December 30, 2025 to December 30, 2026.

This is a request for a one-year extension of an IMA entered into in 2016 between the New
York City Department of Environmental Protection (DEP) and the Westchester County
Department of Health (DOH), which allowed DOH to review and issue written determinations
for all new, altered ,modified or remediated subsurface sewage treatment systems, known as
SSTS. The IMA was a five year agreement with an automatic renewal upon agreement of both
parties for an additional five years, and a new agreement to be negotiated after that. DEP and
DOH are working on a new agreement, but it will not be completed prior to expiration of
current IMA, leading to their request for a one year extension to work out the terms before
requesting authorization for a new IMA. There have been staffing transitions at DOH and
DEP, and the extension will allow new leadership to make the new agreement effective and
efficient.
