CALL TO ORDER  
Please note: Meetings of the Board of Legislators and its committees are held at the  
Michaelian Office Building, 148 Martine Avenue, 8th Floor, White Plains, New York, 10601,  
and livestreamed via the WebEx video conferencing system. Legislators may participate in  
person or via Webex. Members of the public may attend meetings in person at any of its  
locations, or view the meeting and its video recording online on the Westchester County  
the links to documents to be discussed at a given meeting.  
Legislator Colin Smith will be participating remotely from 1132 Main Street, Suite 1, Peekskill,  
NY 10566.  
With a quorum present, Chair Smith called the meeting to order at 1:11 p.m.

ITEMS FOR DISCUSSION

ACT-Westchester County Lessor Prevailing Wage

Stacey Dolgin-Kmetz, Chief Deputy County Attorney  
Shawna MacLeod, Senior Assistant  
Ms. MacLeod said the legislation provides that for any construction project done on property  
leased by the County, where the lease term is 10 years or more and the construction project is  
more than $250,000, the lessor is required to contract with contractors and subcontractors  
who pay prevailing wage.  
Legislator Cunzio asked whether this would go into effect if the County previously signed a  
lease and has not started any kind of construction and override the previous parameters  
outlined in the lease. Ms. MacLeod said the original lease parameters would apply. Legislator  
Cunzio asked whether this would apply if a lease is revised. Ms. Dolgin-Kmetz said it would  
apply if a lease is renewed, but she is unsure if it would apply if a lease is revised.  
With a motion by Legislator Barr seconded by Legislator Cunzio, the committee members  
voted unanimously to go into executive session to discuss legal advice at 1:27 p.m. With a  
motion by Legislator Nolan seconded by Legislator Cunzio, the committee members voted  
unanimously to come out of executive session at 1:59 p.m.  
On motion of Legislator Nolan, seconded by Legislator Barr, the above item was signed by  
committee and referred to Board of Legislators. The motion carried by the following vote:
