CALL TO ORDER  
Please note: Meetings of the Board of Legislators and its committees are held at the

With a quorum present, Vice-Chair Smith called the meeting to order at 11:11 a.m.

ITEMS FOR DISCUSSION  
Act - DEF/EPA Consent Agreement  
Guests: Dept. of Environmental Facilities: Commissioner Vincent Kopicki, First Deputy  
Commissioner Louis Vetrone, Assistant Commissioner Melissa Rotini  
Mr. Vetrone said this will authorize DEF to enter into a consent agreement to settle claims with  
the Environmental Protection Agency regarding the Brockway Place Transfer Station in White  
Plains, which is operated by the County on behalf of Refuse Disposal District No. 1.

With a motion by Vice-Chair Smith seconded by Legislator Williams Johnson, the committee  
voted unanimously to go into executive session to discuss potential litigation at 11:13 a.m.  
With a motion by Legislator Barr seconded by Legislator Williams Johnson, the committee  
voted unanimously to come out of executive session at 11:48 a.m.  
Legislator Pierce asked Mr. Vetrone to discuss the lease agreement and who built the transfer  
station on the facility. Mr. Vetrone said the district constructed the facility, and the property  
was leased to the County on behalf of the district, with the express purpose of building a solid  
waste and recyclables transfer station there in the 1980s. He said he did not recall when the  
lease began, but it expired, and has continued on a year-to-year basis.  
On motion of Legislator Nambiar, seconded by Legislator Williams Johnson, the above item  
was signed by committee and referred to Board of Legislators. The motion carried by the  
following vote:
