Mr. Adin discussed Item #s 2026-40, 41 and 42 together. These three items related to the
arbitration proceeding between Westchester County and Standard Amusements, including
two budget amendments and an amended Bond Act. In July 2025, the arbitration panel found
Standard to be in default for having left management of the park, shielding the County from
additional penalties. These items conclude the BOL’s work related to the settlement.
In May 2025, the BOL authorized $36 million in funding for expenses. This amount included
$24 million in funds to reimburse Standard for money they had invested in Playland, as was
required per the agreement. Since any funds found to be owed to Standard were subject to
18% interest, the County approved funding in order to minimize any interest expense. That
payment was made in May. In November, the County submitted an additional $12 million to
Standard.
As discussed in the meeting, an additional $519,294 representing the final portion of the 18%
interest owed to Standard per the contract provisions needed to be approved.
Two of the items discussed reclassified amounts originally booked to the County’s Operating
Budget, moving them to the Capital Budget. Eligible capital expenditures consist of ride- and
site-related improvements at Playland Amusement Park that were undertaken by Standard
Amusement during its management of the County park. These adjustments included an
increase of $27,710,000 to the Capital Budget and a decrease in the same amount to the
Operating Budget, and an increase of $519,524 to the Operating Budget for interest expense.
Overall, the county paid Standard $36,519,294.
With a motion by Legislator Williams Johnson seconded by Legislator Williams, the committee
voted unanimously to go into executive session at 11:00 a.m. to discuss legal advice for the
three items. With a motion by Legislator Williams Johnson seconded by Legislator Tubiolo, the
committee voted unanimously to come out of executive session at 11:12 a.m.
On motion of Legislator Williams Johnson, seconded by Legislator Williams, the above item
was signed by committee and referred to Board of Legislators. The motion carried by the
