CALL TO ORDER  
Please note: Meetings of the Board of Legislators and its committees are held at the

With a quorum present, Chair Pierce called the meeting to order at 10:37 a.m..

On motion of Legislator Williams Johnson, seconded by Legislator Williams, the minutes were  
approved. The motion carried unanimously.

ITEMS FOR DISCUSSION  
1.  
ACT-First Amendment-IMA-NYCDEP-Watershed  
Joint with B&A, I&H and Health committees  
Guest: Law Dept.: Associate County Attorney Lynne Colavita; Health Dept.: Deputy  
Commissioner Christopher Ericson and First Deputy Renee Recchia  
Ms. Colavita explained that this is a request for a one-year extension of an IMA entered into in  
2016 between the New York City Department of Environmental Protection (DEP) and the  
Westchester County Department of Health (DOH), which allowed DOH to review and issue

written determinations for all new, altered ,modified or remediated subsurface sewage  
treatment systems, known as SSTS. She said the IMA was a five year agreement with an  
automatic renewal upon agreement of both parties for an additional five years, and a new  
agreement to be negotiated after that.  
She said DEP and DOH are working on new agreement, but it will not be completed prior to  
expiration of current IMA, so they are requesting a one year extension to work out the terms  
before requesting authorization for a new IMA.  
Deputy Commissioner Ericson said that there have been staffing transitions at DOH and DEP,  
and the extension will allow new leadership to make the new agreement effective and  
efficient.  
On motion of Legislator Williams, seconded by Legislator Tubiolo, the above item was signed  
by committee and referred to Board of Legislators. The motion carried unanimously.  
2.  
Act - DEF/EPA Consent Agreement  
Joint with B&A and LIT committees  
Guests: Dept. of Environmental Facilities: Commissioner Vincent Kopicki, First Deputy  
Commissioner Louis Vetrone, and Assistant Commissioner Melissa Rotini  
Mr. Vetrone said this will authorize DEF to enter into a consent agreement to settle claims with  
the Environmental Protection Agency regarding the Brockway Place Transfer Station in White  
Plains, which is operated by the County on behalf of Refuse Disposal District No. 1.  
With a motion by Legislator Williams seconded by Legislator Williams Johnson, the committee  
voted unanimously to go into executive session to discuss potential litigation at 11:15 a.m.  
With a motion by Legislator Williams Johnson seconded by Legislator Williams, the committee  
voted unanimously to come out of executive session at 11:48 a.m.  
Chair Pierce asked Mr. Vetrone to discuss the lease agreement and who built the transfer  
station on the facility. Mr. Vetrone said the district constructed the facility, and the property  
was leased to the County on behalf of the district, with the express purpose of building a solid  
waste and recyclables transfer station there in the 1980s. He said he did not recall when the  
lease began, but it expired, and has continued on a year-to-year basis.  
On motion of Legislator Williams, seconded by Legislator Williams Johnson, the above item  
was signed by committee and referred to Board of Legislators. The motion carried  
unanimously.
