PH - Apprenticeship Program
This item was discussed in conjunction with item #2. Pursuant to the New York State Labor
Law section 816-b, municipalities, such as the County of Westchester, are authorized to have
a State-approved apprenticeship program. Approval of this local law would impose the
requirement for all contractors and subcontractors seeking a County construction contract
exceeding $250,000 to have such program as approved by the New York State Commissioner
of Labor. Some of the requirements include the need for a minimum apprentice graduation
rate of 30%, that contractors have proof of their apprenticeship program at the time of
application and that subcontractors execute their apprenticeship program within 90 days of
being awarded the contract, among others. Failure to comply with this program would then
involve the Department of Law to step in for breach of contract via the Department of Public
Works and Transportation. The committee members expressed support for this legislation and
noted that apprenticeship programs not only promote workforce development, but also
improve accountability and fairness in public contracting.
